BIRMINGHAM, AL (WBRC)- An attorney representing 23 former Jefferson County employees contend that they should be back on the job because the county failed to follow personnel procedures.
In December, employees at the then Cooper Green Mercy Hospital were put on leave without pay. The county was preparing to transition the hospital to an urgent care center, saying that the hospital was costing taxpayers millions of dollars.
Monday, Birmingham attorney Emory Anthony filed a motion with the judge hearing the dispute. Anthony says the county cannot lay off workers for financial reasons without a hearing 30 days after giving notice of their appeal.
"Put them back to work and give them back pay because under the rules of the personnel board a public hearing should be had within 30 days," Anthony said.
Anthony contends that the county should have come with a reduction in force plan first and then put employees on administrative leave without pay.
Now Jefferson County Manager Tony Petelos has said before that the proper procedures were followed.
